DUNCAN, Judge. OPINION The petitioner, Clayton Young, has appealed from a judgment of the Davidson County Criminal Court dismissing his petition for a writ of . On January 8, 1968, the petitioner was convicted in the White County Criminal Court for assault with intent to commit murder in the first degree, receiving a penitentiary sentence of not less than 3 years nor more than 10 years but was placed on probation. His probation was revoked on May 11, 1971, and he was committed to the penitentiary to serve his sentence. On May 11, 1972, he was granted a parole by the Tennessee Board of Pardons and Paroles.
